However the Defendants are now divorcing and Def. Viola is claiming an interest in said land. The land in question lies in the 5th Civil District of Claiborne County, Tennessee. |

Plaintiffs then paid Hutchins to have her attorney investigate the title. The attorney stated that the title was good. When the plaintiffs attempted to sell a part of said property, a second title search found that Goddard did not have full title to the property. Johnston, Sr. later conveyed the land to his co-defendant with the understanding that the plaintiff's rights to it were to be protected. She later filed for divorce from the co-defendant and took the rights to the land. |

Plaintiff is sued by his guardian, Nota Turner Lowery, and is the only heir of Martin V. Turner (dec'd), who was in possession of land described in the file. The defendant secured from Jesse and Joseph Burges land by a claim deed that was registered with the county. The plaintiff now charges that the Burges' never claimed to own any land in the said section and the defendant is attempting and threatening to enter upon the lands of the plaintiff. |
