Ziegler executed a warranty deed to W. M. Holder, father of plaintiff and certain defendants. After W. M. Holder's death, Elridge tried to claim sole ownership of the land and subsequent mortgage from the bank. Plaintiff avers that the number of interests in the property makes it impractical for it to be partitioned by a will. |
