View Entry 1878 David Snyder v. S. M. Branner et al. Jefferson Land and Title Dispute

2 folders. In Joseph Emsley Bettis purchased 106 acres from Duke Bettis. Duke did not have a clear title on the land, as it had not been transferred from previous owner, William Walker. Debts and land continued to transfer to new owners, who made attempts to recover their debts from Emsley, and to be granted a clear title on the Walker land. Within the chain of title are Snyder and Branner.

View Entry 1870 Enoch Marshall v. George Hawn Jefferson Land and Title Dispute

Marshall sued to recover possession of tract of land once belonging to Hawn but now belonging to Marshall based on court judgment, execution, levy, and sale upon said deed to Marshall. Hawn refused to surrender possession. Marshall's could not issue action of ejectment due to the justice's judgment being lost. Court dismissed the plaintiff's bill.

View Entry 1873 Frank Brazelton, et al. v. William A. Montgomery, et al. Jefferson Land and Title Dispute

Additional plaintiffs: Frank and Mollie Brazelton, minors by next friend George A. Fain, Samuel N. Fain, and William Brazelton, Jr. Plaintiffs sued Montgomery, et al. over a deed and title to land. William Brazelton gave deed to tract of land to Samuel N. Fain. A lien was placed on land for payment of $1000 to R. C. Jackson. Plaintiffs charge that deed did not invest William's son James R. Brazelton with title to land. There was a large amount of unpaid taxes due to Jackson. Montgomery claimed mortgage.

View Entry 1839 Grannis White & Co., et al. & Co. v. Henry Smith, et al. Jefferson Land and Title Dispute

Suit filed by Grannis White & Co., L. M. Wiley Parrish, & Co., Weed & Fanning, Hyatt M. Burney & Co., & Miller Ripley & Co. to declare deeds of conveyance for land, slaves, & merchandise void. These purchases were made by Henry Smith to Carter & Lewis F. Leeper, William Carter & William Moore. The property was to be used to satisfy judgments the pl's recovered against Smith.

Land in dispute is referred to as the Upper & Lower ends of Rocky Valley Tract and the Sevier County Tract. Isaac Grant, Jr. sued for recovery of rents and profits from the land, which Grant and his sister Amada Foland, wife of Daniel Foland, inherited from their father, Isaac Grant, Sr., dec.

View Entry 1859 John & Hiram Moyers v. Silas Moyers, et al. Jefferson Land and Title Dispute

Brothers John and Hiram Moyers sued other brother Silas Moyers over land owned by their father, Joshua Moyers. Joshua gave a deed of gift for the land to Silas. But after Joshua dies, land was sold and purchased by Col. Roper. Dispute continues. Refers to previous case: Thomas Brown v. John Moyers, Hiram Moyers, Alfred Moyers, and Silas Moyers (Box 1126). Silas had been made trustee of land. John and Hiram sue Silas for not conveying equal portion of the land. Includes petition by Alfred Moyers.

View Entry 1853 John Den, lessee of William Jack & Joseph McAllister v. Joseph Hamilton Jefferson Land and Title Dispute

Jack & McAllister got judgments against Hamilton (as did 2 others) & all 4 judgments were satisfied by selling Hamilton's land, at which sale Jack & McAllister purchased the land. Dispute over effect of Hamilton's possession on title of Jack & McAllister. Land at issue bordered Nolichucky River & included the William Anderson tract & the Soldiers Rest tract.

View Entry 1857 John Baker v. Joshua Morgan et al Jefferson Land and Title Dispute

Add. defs: John Chase, Jacob P. Chase, & children of William Chase (dec)--Emaline (m. T.A. McKinney), & minors Margaret, Elvin, Nancy Ann, Charles, Thomas & Cyrus Chase. Baker recovered various judgments against John, Jacob & William Chase, & brought suit to satisfy said judgments out of land Obed Chase left to sons John, Jacob & Wm, which land was then in possession of def. Morgan. Jane Chase originally named guardian for minor Chases but, when she failed to answer bill, replaced by Wm M. Bradford.

View Entry 1868 Jacob Peck v. William Brazelton & William Dick Jefferson Land and Title Dispute

Peck indebted to Gen. Brazelton (who had market in New Market after which town was named; the 2 had history of financial dealings). Secured debt w/deed on 1,000 acres, w/Dick as trustee. On advice of Peck's 2 sons W.R. & Isham T. (visiting from Louisiana), & in effort to settle up, Peck deeded 200+ acres of this land to Brazelton; Peck says intended as mtg. Brazelton took possession of this 200+ acres, leading Peck to file this suit. NOTE: Peck, TN Supreme Court judge from 1822-34, died in 1869.

Sallie Hawkins was the wife of Kindrick Hawkins. D. M. Coile was the deputy sheriff of Jefferson County at the time of the case. Additional case names: W. C. Bayless and Florence N. Bayless.

View Entry 1889 Louisa H. Henry, et al v. John Burchfill, et al Jefferson Land and Title Dispute

Louisa H. Henry sued by next friend, John Henry. Add dfnt: Randle Reese. Louisa Henry claimed to be the only child and heir of James Laff, dec. She claimed her husband, L. E. Henry, conveyed land 80+ acres to Laff. Case is a dispute over the ownership of this land.

Plaintiff widow of W. J. Rainwater, other plaintiffs his heirs. Plaintiff sued to recover "possession and title" to two 25 acre tracts originally conveyed to her husband in Feb. 1853 by Miles Rainwater. In 1863 def. Rainwater took possession of land without their consent & sold it to deft. Burchfield. Identity of deft. Rainwater uncertain. Also mentioned: Eli, E. D., Katherine M. W. & S. J. Rainwater & Louisa Burchfield.

Add. Defs: Martha Ann Ford, Joseph Shelby Ford & William D. E. Ford, minors, sued by their next friend Eliza J. S. Ford. Dispute over 2 adjoining tracts of land (one 100-acre & one 160-acre) on Flat Creek. Court ruled for Pla. re 100-acre tract & for Def. re 160-acre tract. Two exhibits (included in page count): both are plat maps related to the property in dispute.
