McPherson and McSpadden exor. of Enoch Thomas, dec. Additional defendants: Marthana Thomas, late widow of Enoch Thomas; Polly White, wife of Samuel White, Melissa McCamish, and Isabella Thomas. Eliza is a daughter of Enoch Thomas. Enoch Thomas used Eliza's money to attain grant for land. Eliza claims the right to legal title of land and states that she and Enoch entered contract that upon his death, land would go to her.

View Entry 1867 James A. Dorsey & Salina Jane Dorsey v. Dimmon Dorsey Sr, McCamy W. Dorsey, William Dorsey, & Dimmon Dorsey Jr Bradley Land and Title Dispute

Dimmon Sr & son John Dorsey (pla. James' dad) bought Hiwassee district land from Robert Cowan; Dimmon's name not on deed. John advanced lg portion of purchase price & had agreement with Dimmon that he would have part of the land, upon which part John settled & built house & stables & cultivated. John died when pla. James was young & due to his mom's health, they went to live with his grandfather James Gant, never intending to abandon their right to said land, at which point Dimmon Sr took possession.

John & Arthur Cotton were the heirs of Thomas Cotton, deceased. His father attained two plots of 600 acres of land in his lifetime, North Carolina land grant # 246. However, there was an error in the grant, and the details did not align with the information attained by the original survey conducted by John Buchannan.

The plaintiff was married three times, the last time to R.J.D. Levi, who left her property. She has the power to dispose of the property by deed or will. The defendants reside on the property and refuse to vacate.

View Entry 1867 Joseph S. Milligan, et al. v. Andrew L. Rogers, admr. Of Gideon Morgan, dec. Monroe Land and Title Dispute

Morgan had filed his bill against Milligan in 1847 in order to divest the title of a tract of land out of Milligan and vest it in himself. Claiming to be judgment credior to Milligan, Morgan had obtained a decree against Milligan in Chancery court for $336 in 1834. A reference to case Joseph Milligan v. Gideon Morgan in ET 676. Rogers obtained decree in 1857 against Milligan, which Milligan wants set aside. He also wants an injunction to stay issuance of writ of possession from other court.

View Entry 1867 Lydia Ann Torbett v. Hugh Torbett et al. Sullivan Land and Title Dispute

Land dispute over 125 acres of land in Sullivan county originally left to plaintiff and their children by her deceased husband, Samuel Torbett. Plaintiff gave up the land to the Bank of Tennessee and was not entitled to dower in the said land unless the debt on the land was removed. Additional defendants: Joseph Torbett, Samuel Torbett, Sallie Tobertt, Catherine Torbett, David Hughes and James Hughes.

View Entry 1867 Martin S. Reynolds v. Toliver Baker et al. Knox Land and Title Dispute

Additional defendants: W.W. Walker and Joseph H. Walker. In suit against the East TN & Georgia Railroad Co. several years before, a judgment was obtained against Reynolds for $55.55, which was levied on a tract of land. Walkers had bought land who conveyed it to Baker for $1100 in Confederate money. Walkers refused to allow Reynolds to redeem property because he was Unionist, whereas Walkers were Confederates. Reynolds charges sale to Baker void because of use of illegal currency.

View Entry 1867 Mary Ruth McCarty, et al. v. James White, admr. of Robert R. Kyle, dec. + Edmond D. Wilson by next friend, et al. v. Mary Robert Kyle Hawkins Land and Title Dispute

Transcript of two causes consolidated. In first case, Mary Ruth McCarty, et al. (there are many additional plaintiffs) were sued to collect debt from Kyle's unpaid rents on James R. McCarty, dec.'s property. In second case, Fain by next friend of Edmond D. Wilson, who with several other heirs of James R. McCarty were suing Mary Robert Kyle, minor, to reclaim title to James R. McCarty, dec.'s land, which was fraudulently taken by Robert Kyle.

pla. Lavinia, dau of John Freshour Sr, was first married to Jabez W. J. Kelly, who died suddenly few wks after marriage, with dau pla. Mary Jane (only issue) born after his death. Jabez & bro Def Joshua jointly owned land, carried on 2 distilleries, were both farmers, heirs of John Kelly (w/bro Ross, teacher). Dispute re title to this land, incl 4 entries (2044, 2045, 2046, 2052) in Greene Cty entry taker's office, Dudley tract (175 acres on Cove Creek) & more. James M. Conduff died during suit.

View Entry 1867 P. M. Hyder v. Herod Turner et al. Putnam Land and Title Dispute

Additional defendants'. W. Hawes, J. L. Hyder, Henry Whitaker, James M. Douglass, Andrew Brown, Abraham Ford, S. D. Burton, H. Denton, assignee in bankruptcy of J. W. Crutcher, A. H. Ditty, admr. of R. Dyer, dec. & L. E. Martin. In April 1868, plaintiff conveyed to defendant a tract of 10 acres of land which included a grist and saw mill for the purpose of securing the payment of several debts. Hyder was appointed trustee to carry out conditions of the deed trust.

View Entry 1867 Prudence Carmichael v. C. C. Smith, et al. Grainger Land and Title Dispute

Additional defendants: James T. Carmichael, George Carmichael, John Carmichael, and many others. Complex case regarding previous lawsuits. A joint decree was rendered in all these cases against James Carmichael. James left for South Carolina during war to be within Confederate military lines. His lands were sold by decree and purchased by plaintiff in 1865 but were seized by U.S. gov't under Second Confiscation Act. Freedmen's Bureau given possession later. Plaintiff wants her money refunded.

View Entry 1867 Robert L. Gamble v. John H. Hardin & James F. Guardenhire Hamilton Land and Title Dispute

Plaintiff purchased a life estate belonging to James C. Anderson who had been engaged in armed rebellion against the United States and therefore lost his land due the Confiscation Acts passed in 1861 & 1862. Plaintiff sold the land to Hardin and Hardin transferred his note on lot to James Guardenhire and Guardenhire has demanded a writ of possession from the Clerk & Master and is threatening to have Gamble kicked off the land.
