In 1908, the plaintiff was indebted for a mortgage on a series of notes for $75 each with interest. He saw S. Hirsch to nego- tiate a new mortgage and borrowed $3,000 to take up the old mortgage, to be paid back in one hundred $40 payments with interest. Plaintiff began getting statements from the Association, to which he never made and made no mention of the conveyance. |
