Plaintiff sued to collect $2,295.81 from defendant, who had entered into bond with Southeastern Paving & Construction Co. to pay all claims for material furnished Southeastern Paving for the construction of a highway in Carter Co. known as State Aid Project No. 6448-A, Carter Co. Southeastern Paving refused to pay plaintiff & has since entered bankruptcy. Defendant denies any liability on grounds that Atlantic did not file its suit within required 60 days.

Partial case: recovery of debt against the defendant for tan-bark, sold & delivered to the defendant as provided by contract.

Monies had originally been paid by W.E. Newell and Co.

Plaintiff, the Bank of Lewisburg sought recovery of funds, $314.05, of defendant T.A. Montgomery, former bookkeeper of this bank. The bank charges that the defendant was in debt due to 'over check'. Defendant insisted the bank owed him $320.00 in salary Witness to the defense: John Wallace, employee of B.O.L., and the defendants father, R.S. Montgomery former president of the bank.

Additional Plntffs.: George W. Pemberton & L. B. Goad. On 16 July 1859 a judgment of $128.57 plus costs was rendered against the plntffs. & in favor of the defts. Since them 3 executions have been issued as defts. Attempt to collect the judgment. Plntffs. granted an injunction prohibiting the defts. From taking further action in attempting to collect the debt until the case could be reheard.

Max J. Winkler originally sued plaintiff to recover an unpaid loan of $25 plus $1.20 interest & won its case. Plaintiff seeking to reverse this decision. Max J. Winkler Brokerage Co., managed by M. S. Umbenhauer, did not describe itself as a loan company. Umbenhauer stated that his firm "was engaged in the business of buying and discounting salaries". The firm also kept no record of accounts. When a party paid his note off or satisfied the bill of sale it was torn up.

D. J. Thomas is looking to recover $3,690.61 from the defendant bank for charges against his account for which the bank has no checks or vouchers, claiming to have lost the checks. 3 folders

Farabee-Treadwell and Company was a wholesale grain dealer in Memphis. They previously sued F. P. Moore and Company of Shelbyville, Illinois for damages over the quality of hay. Chafee and Chew represented Farabee-Treadwell in this previous case. This case deals with disagreement over the $50 fees due to Chafee and Chew for serving as the lawyers for Farabee-Treadwell.

James sued to recover $300 from Galyon, the amount of his unpaid commission for his services in "procuring lease on Main Street near Belt by crossing" in Chattanooga.

Origin of recovery: Livestock purchased by Plaintiffs from Defendant was sick, and died. Exhibits include Bill of sale, cancelled check, note.

The defendants contracted with the plaintiffs to ship a load of mules and one of the mules became disabled.

Additional Plaintiff: Commercial Credit Co. Hoback Motor Co. comprised of Jack Millard & Mitchel Hanks. Defendant originally sued to recover $365, value of a truck she traded in partial payment for a DeSoto Sedan. Car repossessed when plaintiff missed her first monthly installment. She was advised by her attorney that she could sue for the recovery of the $365 if car was not advertised for sale within 10 days. Disagreement as to whether car was advertised within required time.

Origin of recovery: overtime pay.

This suit was instituted by plaintiff, sued on behalf of himself and other employees, for the recovery of back wages and liquidated damages.

Exhibits: insurance policy, statement of accounts, receipts, and collection notice. Defendants are Dewit Buck and George Buck, doing business as Buck Brothers and Company, for the use and benefit of Lemon and Gale Company and E. E. Bolin. Cause of action: recovery of $1600.00 on a fire insurance policy. The policy was taken out on merchandise and fixtures for a store in Holmes County, Mississippi.
