C. W. Yeary was accused of shooting an killing Obie Herrell. Herrell and friends came to Yeary's store at night and were causing trouble including verbally abusing Yeary and his wife. It is alleged that Johnson and Berry's wife Zella Harrell had been intimate, and that Zella may have miscarried Johnson's child after he attacked and forced himself on to her. John Johnson lived with his brother Charley and sister Lelie on the farm where Robert Berry was raised. The murder occurred across the road from a store owned by Clint Herrell. |

Odell charged w/killing Peter Stewart by poisoning w/strychnine in proof vial, having intended to kill Richard & Eli Brewer, but 11-yr old Stewart used vial to drink hog backings, not knowing of poison; died next day. Goodman (who lived w/grandpa Jesse Goodman) charged w/accessory before the fact for hiring Odell to do it. Jury convicted Odell of 2nd degree murder, 10 yrs prison. Witnesses: Peter's dad Boyd, bro Vesta, sister Catharine (m. Callahan Goodman, killed by son of George Brewer, stiller). |

The def. is accused of murdering his wife, Margaret A. Lowder, with a gun. Def. claims he was cleaning the gun when it accidently fired. After his wife's death the def. quickly moved in with and married Sarah Babb, then 18 or 20 years old. During the trial Caroline Richmond (col.) testified that the def. came to her to have his fortune read and confided to her that his wife was sickly and that he would marry Babb when she died. Def. and his wife had three children together. |
