Johnson, J. L. Lamping, and Lena H. Graper on a note past- due. Montgomery asserted the note was fraudulently removed from his safe deposit box at the bank he and H. E. Graper were employed. Defendants formerly in the mercantile business under "Montgomery & Sons" and that his stock of goods and fixtures were destroyed by fire in January 1923. Plaintiffs claim that at the time of the fire the defendants were indebted to many wholesale firms therefore it was arranged that A. S. Montgomery would act as receiver, to receive payment of all insurance on his stock of goods and pay out all the bills they owed. Among these bills were notes owed to bank. |
