McDonald for the use of the trust due two years from date being the second installment of the purchase money of Lot #6 of the land sold in said clause, said note of $3,446.98 plus interest. Plaintiffs claimed the note had not been paid.

Plaintiff was a son of John Moorehead, dec. and executor of his estate. He filed the original bill in 1868 against Mary Gray et al, the heirs and legatees of the estate for the construction and settlement of the will. In 1871, the suit concerned the payment of two notes to John Moorehead from 1859 from J. L. Gray and Mary Gray.
