In 1857, the plaintiff and defendant purchased jointly, a tract of land from Michael Bashor for $1,340. The plaintiff paid $400 in cash at the time of purchase and the two parties executed joint notes to Bashor and parties Bashor owed money for the rest. The defendant claimed he paid $187 more than the plaintiff, who was bad with numbers and accepted the claim, signing several notes to equalize their ownership. Later, the plaintiff discovered he was misled and overpaid prompting this suit. |

The suit was brought in order to collect an amount due on a note given by J. McCoy to Everett & D. [?] Broyles. McCoy intended to buy one-half interest in a saw & grist mill property. Everett and Raulston were absent when a judge ordered the mill property to be sold. Bill Hackney bought it. Complainants charged that Duncan (their agent) grossly abused their faith and confidence in him, causing them to lose the mill. Much explanatory testimony starting on p. 33. See ET 71 |
