Plaintiff Haskins sued the defendant as his security for a $800 note executed to Joseph McCulley for money loaned to Hammond. Haskins and Varnell charged that Hammond, after accumulating many liabilities and creditors, conveyed his lands to his wife Mary to avoid his real estate being subject to liability for his debt. Plaintiff requested the court declare the conveyance fraudulent and subject the defendants property to sale for repayment of debts. |

The suit alleged that W. N. Keller had sold the hose and the Roberson's but had never paid off tow notes payable for $1000 each. He bank sued to force a sale of the property to collect debt owed. House and lot were on Main Street. The defendants counter-sued. Case file consists of both. |

Plaintiffs claimed that in 1883, they executed several promissory notes to A. J. Pratt, an unfortunate invalid and cripple who wished to start a business to manufacture broom handles. This would enable Pratt to support himself and his ageing father, who was also a cripple. He used the money as collateral to purchase machinery for the [failed] venture. A check was drawn by an unnamed party from the Peoples Bank for $260 payable to T.M. Morgan and signed by J.R. Young, the depositor of the plaintiff. Though check as suspicious, since it as endorsed by the defendant, the plaintiff paid the amount. It was later discovered to be a forgery. Plaintiff demanded the defendant to return the money, which they had failed and refused to do. Plaintiff suing for said $260. |
