View Entry 1892 Joseph Wheless, et al v. First National Bank of Murfreesboro Davidson Non-payment of Bank Note

This case was filed by the heirs of Gen. John F. Wheless, dec. Wheless was the owner of the Belmont Flouring Mills, prior to his death he had taken out notes from defendant company. Notes were not repaid. Company was declared insolvent and became property of bank. Plaintiffs filed this case to have property and company returned to them and claimed that they were unaware of unpaid debt. Additional Plaintiffs: Annie Blakely, John H. Blakely, W. T. Wheless. This bill was brought to collect a note signed Crescent Mining Co. payable by L.P. Thatcher, John H. Thatcher, and W.C. Thatcher for $1000. It was alleged by one W.M. Nixon that Crescent Mining Co. was never probably organized as a corporation. See related case, Fourth National Bank et al. v. Cresent Mining Company et al. in ET 1966.

Addtl pltfs.: Bettie & E. C. McDowell, Annie M. Brown, Mary Myers, Lena Myers, and all heirs at law of L. D. Myers. Addtl dfnts: O. Z. Bond, wife of John B., and John & Florence Hurn. The pltfs sold to dfnts Bond a certain lot of land in in Maury County the total amount due 12 months after the death of dfnt. Payments were to be made annually until the death of dfnt on Nov. 15, payments were missed. Pltf sued for payment and interest on said note.
