Shipley borrowed $3000+ to buy stock in Sterchi Bros. Stores. To induce bank to make the loan, Sterchi officer C. C. Rutherford guaranteed the bank against any loss on the stock for 3 years. The stock depreciated to a value of $300, so Rutherford reimbursed the bank only $1000. Court ordered Rutherford to pay debt, and Shipley was liable for repaying the remainder of the loan. Charles A. Redmon, Odessa's father, operated a grocery store and occasionally bought goods from the Fraziers. At the time the note was sued on, Redmon owed Fraziers nearly $69. Frazier threatened to take legal action to close Redmon's store, but agreed to accept a note w/proper endorsement. Note bore signatures of both Redmons, but Charles had forged Odessa's. Frazier's son went to her house & demanded that she sign the note. She refused, so T. A. told her that her father had been arrested. (He hadn't.) |
