Plaintiff is sued for a $35,000 promissory note that is past due. The debt is over tract of land located in the 4th Civil District in Morgan county. Trust deed was executed to secure and the note and interest. Trust deed is still enforceable and still constitutes a lien upon said land for purpose of satisfying payment. Amy C. Davis, wife of J. M. Davis is also mentioned as defendant in transcript. Defendant said deed trust was for $5,000 and was paid. See ET Box 32 & 1438 for additional part of case.

John L. Case alleged that Moses Howell owed him money on three notes related to a land transaction in Cocke Co. Moses Howell filed a cross bill stating that the notes provided by Case are not accurate.

Plaintiff Champlin sued for payment of a note executed by the defendants C. C. McCullough and F. Gibson.

Additional Defendants: Alexander McGhee, Matthew W. McGhee, William S. Blair, William Upton. This case involved land sold by a Cherokee named Cabin Smith that he received out of the Treaty of 1819 and conveyed to Gideon Morgan who conveyed to John Lowry Lowry claims to have rented land called Blair's Ferry to Blair and McGhee who signed a note. This action was instituted to collect on the note.

The plaintiffs were husband and wife. Case involved a note for a trust deed on a tract of land in the town of Henderson.

Sherfy sued Argenbright over promissory notes he made out to defendant in 1863 for $770 in Confederate currency and in 1865 for $866.25. To secure payment of the 2nd note, Sherfy's land was placed in a trust mortgage to be sold and proceeds used to pay notes. Sherfy wanted both notes to be voided and the trust mortgage cancelled.
