J. W. Wilkerson, the Marshal of Lenoir City asked John Glass to purchase whiskey from the Pla. in error in an attempt to see if he was illegally selling whiskey. Wilkerson succeeded in purchasing the whiskey and received a shipment several days later. Hix argues that Wilkerson made him believe the whiskey was for a sick relative and that he sold it to him out of kindness. Casefile includes a price list for various amounts and types of whiskey. Defendant was indicted in the September Term, 1870 for having "carnal knowledge of a female under the age of ten years" on 10 March 1868. Circuit judge quashed the indictment on the grounds that Loudon Co. had not been formed at that time. Supreme Court ruled that the Circuit Court judge erred in quashing the indictment. |
