Charles and Elizabeth, his mother, were exe. Of will of John Greene, dec. In previous case, judgment had been rendered in favor of Jobe and against plaintiffs for $411.46. Plaintiffs had paid $321.74 and paid balance sometime later. Jobe issued for whole execution at first, then remembered later that $321.74 was paid, but still wanting the rest of the judgment. Plaintiffs seek stay of execution, charging that they had paid balance.

The plaintiff was a wholesale merchant from New York who opened an account with defendant, Lizzie Russell, the sister of J. R. and E. T. Russell (add defendants) who were Washington Co retailers. Consolidated case of D. K. Self v. Teleford Ag. & Man. Co. and West, treasurer of the Elders and Deacons of Salem Church v. G. W. Teleford et al. Telford owned two mill sites on Milestone creek at Telford Station, which he sold to the Telford Ag., who still owed money on notes for the sale. When the company later failed, the plaintiffs, as creditors of the company, filed the bill to settle the company affairs and sell the real-estate of the insolvent company to recover their funds.

Additional Defendants: Robert P. Rhea & Joseph S. Rhea. Additional Plaintiff: Byrn. Dispute relates to judgment rendered in favor of pla. against Defs & executed by levying on negro named George, property of Def. John Rhea. Court refers to Act of Assembly, passed in January of 1861, providing for the stay of collection of debts, and in doing so, states its opinion that at least a portion of that Act is unconstitutional under both the TN & US Constitutions.

Charges include alleged usury, alleged deed irregularities, alleged survey irregularities. Hoss owned the Hoss or Greenwood Hotel in Johnson City. She secured a loan using the land around the hotel for collateral. However, she did not mean that the hotel or the land it directly sat upon was included as security. 6 folders.

The defendant hired the plaintiff to haul certain personal furniture belonging to one Mr. Weatherly, the brother of the defendant's wife, for the sum of $75.00. The defendant failed to pay the fee upon delivery and was ruled against in a Johnson City court to pay the fee, but still failed to pay, resulting in the current case.

Defendant was a partner in the Atlanta Lunch Room and ran a credit with the defendant for goods totaling $196.32, of which he paid $83.72 but discontinued payments. A balance of $111.79 was left on his account with the plaintiff.

Additional Defendant: J. M. Hoss, J. H. Hoss, J. H Dosser, S. J. Kirkpatrick, W. H. Correll, C. E. Dosser, Bruff Maddox & Falker, Hustzler Bros., and Tucker, Smith & Co. The plaintiff claimed that J. M. Hoss was indebted to him for two promissory notes executed by him and J. M. Johnson in 1883 for $831 each. St. John requested that all parties provide a full accounting of the properties liable for repayment and that a levy of attachment be placed on all effects in the control of the defendant trustees.

The ads in question are included as exhibits in this case file.

In 1937, the defendants took out a loan from the plaintiff for $200 to be paid back over 19 months with an interest rate of %3.5 per month. The defendants made four payments before stopping, causing the plaintiffs to declare the balance of the loan past due. Defendants are now wholly indebted to the plaintiffs in the sum of $171.82 plus $24.36 in interest.
