Walthal Bros. undertook to sell a house and lot for Greener to Rosenbloom and got a contract of purchase accompanied by a check to pay the earnest money. When Greener tried to cash the check he discovered a stop payment had been placed on it. Rosenbloom chose not to pay, thus Greener returned the check to the purchaser, tore up the contract and sold the property to someone else. Walthal Bros. sued for full commission.

The defendant failed to pay the note or file for the transfer of the land.

View Entry 1921 Pierce & Fry v. Sam Applewhite Obion Debt on Account

(Rice A.) Pierce & (J. L.) Fry are a law firm, sued the defendant for non-payment of legal fees in an earlier case, known as the "Night Rider Case," in which they defended him against the charge of murder in the first degree for killing Captain Quentin Rankin in Oct 1908, Applewhite named as one of the eight men who "took Captain Rankin out one night" near Reel Foot Lake and murdered him. Others were Garret Johnson, Arthur Cloar, Fred Pincon, Roy Ransom, Bob Huffman, Tid Burton, and Bud Morris.
