Anderson bought property adjacent to Georgia Ave. in Chattanooga. At time of purchase, a fence which abutted sidewalk running along street had been knocked down by trespassers. After he replaced the fence, believing it to be the boundary of the property, he received letter from the city marshal ordering him to move the fence back 9-13 ft. from the sidewalk or it would be torn down. Anderson was seeking to confirm that the property line was at the edge of the sidewalk. |

Additional plaintiff: Elmore Brack. Additional defendants: W. H. Brack, B. F. Martin, Graves Knox and Co., and the heirs of Moses Bonners. The defendants (with the exception of W. H. Brack) brought suit and received judgment against W. H. Brack for debt and caused executions to be levied against his one ninth undivided interest in a tract of land. Elmore Brack claims interest in the same land. This suit was brought to determine which parties are entitled to said interest. |
