Original cause was action by defendant Kennedy, damages of $25,000 as result of incident of 1 Sept. 1913 in which defendant was struck by streetcar at the intersection of Florida St. & Gage Ave., Memphis. Multiple serious injuries sustained by defendant Kennedy. Court decision was appealed to the Court of Civil Appeals. Railway filed motion for certiorari seeking to overrule and disallow certain assignments of error.
