Plaintiff was cleaning a gun when it accidently discharged and shot through his wrist requiring a complete amputation of his arm between the elbow and wrist. The defendant, with whom the plaintiff held an insurance policy, has refused to make payment. The defendant claims the accident resulted from voluntary exposure to unnecessary danger and is therefore excluded from their coverage. This is an application for a writ of certiorari forcing a retrial. The original suit was brought against the plaintiff in error for non-payment of an insurance policy. Plaintiff claims that during the original trial the issued insurance agent, James E. Caldwell, was unexpectedly called away from Nashville and by the time he returned, the trial was over and judgment was given in favor of the plaintiff.
