Thomas B. Vanhorn sold some land to Missouri King dec. 1873. She was wife of Thomas King and mother of Mamie King dec. 1887. After Missouri’s death, Thomas abandoned the child and land. Mamie sold some of the land to Washington, who sold it to Napoleon Loder, who sold it to James. After Mamie died, Thomas returned to take possession of the land. James here filed for possession.

He allowed Robert Miller's family to remain on the land until Roberts death when he then had an agreement with Don Miller to pay $150 a year in rent. Later when rent was demanded Don Miller refused to pay and refused plaintiff possession of land.
