On 28 Nov. 1932 plaintiff purchased furniture from the defendant under a retention title contract; on 9 Nov. 1934 defendants repossessed the property without her consent or due process of law & sold it at a private sale for $79.50. At time of repossession plaintiff had paid defendants $43 & still owed a balance of $93.20. The value of the furniture is now less than the unpaid balance. Plaintiff sued to collect the $43 that she has already paid. |

No proof that oil was stolen or that tank cars were defective & leaked. |

Max J. Winkler originally sued plaintiff to recover an unpaid loan of $25 plus $1.20 interest & won its case. Plaintiff seeking to reverse this decision. Max J. Winkler Brokerage Co., managed by M. S. Umbenhauer, did not describe itself as a loan company. Umbenhauer stated that his firm "was engaged in the business of buying and discounting salaries". The firm also kept no record of accounts. When a party paid his note off or satisfied the bill of sale it was torn up. |

Lawrence estate which he had collected from their debtors. In addition, he claimed the money collected had in fact been paid to the decedent's attorney. |
