Daniel Spears said Dariox wanted to shut the road after death of her husband (who built road in first place as way to get to his mill). |

A misdemeanor charge of obstruction of public road was challenged by James M. Lewis, Sr. who claimed the road was a private one. The road was built between 1843-1845 by the owner of the land James L. James. The land was next owned by Col. George Stakes who later sold it to James M. Lewis, Sr. The road obstructed by a fence built by James M. Lewis, Sr. ran from the mouth of Dr. Caster's Lane in Dist. 9 to Cumberland City via Steele's farm. |

Plaintiff brought suit complaining that the defendant loaded and unloaded merchandise in front on plaintiff's building, thus obstructing traffic and causing him to lose customers. |
