The State is arguing that Doad Garner unlawfully and willfully obstructed a public road leading from Sinking Cove and Crow Creek Road to Sherwood by locking gates across the road.

The defendant lived on a public road and put up fences and other obstructions near the property to prevent people from passing by either on horseback or on foot. Case brought against him for impeding the public access through the highway and damaging property of the state in the form of the highway.

Bryant indicted for unlawfully obstructing Turnpike Road leading from Athens to Tellico Plains (chartered under Athens & Tellico Plains Turnpike Co), by nailing plank across it, piling rails & brush on it, building fence across it, & otherwise obstructing it where road passes through farm of John J. Dixon, thereby interrupting travel on the road. Road was made but never opened until recently. After road opened, state discovered Bryant had obstructed it; then failed to remove obstructions after notice.

McCrary owned a tract of 10 acres adjoining the Oakland Gardens Subdivision and had a frontage on a public road (an abandoned street car line), which had been free and open for public use for over 20 years. Plaintiff bought tract 5 years ago and def. or his sons had made low offers for the same land, which pla. Had refused. Plaintiff suing def. for building a fence across said public road, thereby hoping to decrease the value of his land and purchase it for less than its actual value. 2 folders.

Smith & Ellis own land adjacent to each other. Plaintiff claims the defendant blocked a public road that runs across her property in order to cultivate more of her land and therefore makes it nearly impossible for him leave. Defendant claims this was not a public road and offered to create a new road across her land. Exhibits include to two oversize land maps located at M-17-18.
