Testimony re: use of the road, including that there was considerable settlement along Bays Mountain on both sides & they used road. Road also used by those going to Methodist & Quaker Meetinghouses. Daniel Spears said Dariox wanted to shut the road after death of her husband (who built road in first place as way to get to his mill). |

The defendant used the road for hauling out timber and corn from that portion of his land up the hollow, and claimed he was the owner of the land upon which the road was built. |
