The plaintiffs claimed that the defendant told them that the land was well adapted for stock raising, good grazing land, a probability for an early extension of the railroad and had a first class institution for learning. The plaintiffs claimed that all this was false except for the grazing. |

In 1866 Perry received a judgment against plntff. of $572 on a note of $550. Judgment satisfied by sale of 77-acre tract belonging to plntff. Land purchased by Grisham for $611. Plntff. asks the court to void the sale as he was not notified 20 days prior as required by law, & because he only made the original $550 note because Perry threatened his life if he did not do so. Perry alleged that the horse Baines rode during the War had been stolen from him. Baines denies the charge. |
