Plntff. sole beneficiary by assignment of James LaRue. He brought suit to collect on 2 unpaid notes originally due to LaRue. One note was secured in a Deed of Trust executed by Randolph. The other note was for $115 given to LaRue by Francis; Francis used a 135-acre tract of land that he owned as security. Plntff. asked the court to foreclose the Deed of Trust by a sale of the land & that the proceeds from the sale be used to satisfy his debts. |
