Plaintiff & defendants were brothers. John sold a tract of land to William for 2 notes of $175 each ($350 total). After transaction, John moved to Illinois & left the notes w/ Isaac to collect money. William claimed to have paid both notes but then Isaac refused to produce &/or destroy the notes & he could not get the deed from John. William was illiterate while his brothers could read & write.
