Plaintiff, Thomas Herndon filed suit against the defendants, eleven warehouse firms of Clarksville, to compel them to sell him tobacco at their auction. Herndon claimed that all persons have a right to buy tobacco at their public sales despite the defendants position that one must be a member of the Clarksville Tobacco Board of Trade.
