View Entry 1931 Independent Life Insurance Company v. Paul V. Hunter Hamilton Breach of Trust

Original bill was a complaint about the collection of a trust fund by P. V. Hunter in his capacity of agent of the plaintiff, for which it made a bond by depositing with the company $2 per week out of the collected commissions. Hunter also sued insurer for $50,000, alleging that upon retirement the company had tried to libel him with these charges. Exhibit materials are checks and ledgers. View Entry 1893 Joseph Ruohs v. Third National Bank of Chattanooga, et al. Hamilton Breach of Trust

Ruohs purchased 22 bonds of $1k each issued by the town of Athens, in order to by shares of $22k in stock in the Nashville & Tellico Railroad Company, meant to mature in 20 years. Ruohs accuses bank officers John A. Hart, William H. Hart, and W. E.Baskett of selling bonds which they knew to be faulty, insolvent, and possibly invalid. See additional case of Joseph Ruohs v. View Entry 1872 Jesse Glass v. Mary A. Ragsdale Hamilton Deed of Trust

Glass was owner of city lot in Chattanooga and conveyed it to S.A. Key as trustee to secure a debt of $372 to T.K. Warnacut. If debt was not paid in 8 months, trustee could sell land. Glass charged that said deed was security for debt due Warnacut and nothing more-that he has the right to redeem said lot. Though Glass offered Ragadale $675 but she refused. Glass suing Ragsdale to redeem his property.

View Entry 1873 John L. Divine v. Samuel Bard& William T. Goodwin Hamilton Deed of Trust

Divine filed an attachment and injunction suit against Bard and Goodwin from transferring or disposing of any more printing machinery and to have said property attached as payment of Bard's debt. Bard made a deed of trust to Goodwin of 3 printing presses and other machinery relating to printing used in the office of the newspaper formerly known as The Daily Times. Deed was made to secure $2000 from Bard due to Divine by notes.

View Entry 1936 Louise S. Rees, et al. v. First National Bank of Chattanooga, et al. Hamilton Breach of Trust

Chattanooga Savings Bank & Trust, forerunner of 1st Nat'l. Bank, was trustee of estate of Benjamin Franklin Rees (d. 1907). Income from bank's investments to go to brothers & Erlanger Hosp. Investment properties fizzled, so family sued. Reconstruction Finance Corporation had a role, so case could be helpful in researching Depression & banking. M. H. Silverman had questionable involvement. Testimony: N. J. Simmons, E. H. Lawman, A. A. Dragoo, Taylor Durham, I. D. Strong, G. L. Nichols, C. H. Buck.

Additional defendants: J. C. Bankshot, The Fourth National Bank of Chattanooga, and C. W. Coker. The plaintiff was seeking money owed for a trust deed for materials.

View Entry 1876 Nash W. Burt, Trustee for John Thompson v. H. P. Green & Wife, et al Hamilton Deed of Trust

Additional Defts.: M. M. Green; M. J. Gillespie, executrix of J. C. Gillespie, decd. Plntff. asks the court to foreclose on a trust deed on lots that the defts. transferred to Thompson as security on a $300 note in 1873. However, in 1872 a suit had been brought against Green & his wife to enforce a vendor's lien on the lots. The lots were sold to M. J. Gillespie, executrix of J. C. Gillespie. decd.

View Entry 1878 State v. James O. Senter Hamilton Breach of Trust

Senter, an attorney and agent for Abraham Miller, accused of appropriating for his own use $900 of a $1,018.40 U. S. Treasury certificate payable to Miller. The money was bounty & back pay due Miller as the father of Samuel S. Miller, a U. S. soldier, 2d Lieutenant in Co. K of the 9th Regiment of Tennessee Cavalry Volunteers. Senter charged with "fraudulent breach of trust".
