Original bill was a complaint about the collection of a trust fund by P. V. Hunter in his capacity of agent of the plaintiff, for which it made a bond by depositing with the company $2 per week out of the collected commissions. Hunter also sued insurer for $50,000, alleging that upon retirement the company had tried to libel him with these charges. Exhibit materials are checks and ledgers. Fizer offered Jackson partnership in a livery company. At the time of the stock trade, Jackson, who had a tidy inheritance, was allegedly so drunk as to be incapacitated. Some stated that he was mentally unbalanced at the time of the deal. It was suspected that in making the trade, Fizer took advantage of Jackson's state and cheated him. View Entry 1896 James M. Head, trustee v. William Moore Davidson Deed of Trust

James Head, trustee for Mechanics Savings Bank and Trust Company, the City Savings Bank, and the Commercial National Bank, claimed that defendant William Moore executed a trust deed to the complainants upon real estate in Nashville for the purpose of taking loans out from the banks. Head requested that because Moore owed money on loans and failed to pay taxes and insurance on the property, the property should be sold to pay back debts to the complainants, liens, taxes, and insurance.

Jim Prater is accused of fraudulent breach of trust by one John Lewis. The charge stems from a note that was issued between the two men.

View Entry 1817 John Overton, assignee of William P. Anderson v. Ralph Crabb Franklin Breach of Trust

Crabb agreed to sell land for no less than $1200, giving Anderson half of the profits. Crabb then sold the land to Hezikiah Faris for $1280 and gave Anderson nothing. Anderson sued to recover the proceeds of the sale.

View Entry 1893 Joseph Ruohs v. Third National Bank of Chattanooga, et al. Hamilton Breach of Trust

Ruohs purchased 22 bonds of $1k each issued by the town of Athens, in order to by shares of $22k in stock in the Nashville & Tellico Railroad Company, meant to mature in 20 years. Ruohs accuses bank officers John A. Hart, William H. Hart, and W. E.Baskett of selling bonds which they knew to be faulty, insolvent, and possibly invalid. See additional case of Joseph Ruohs v. View Entry 1916 James T. Snodgrass & Fannie W. Snodgrass v. Charles E. Keyes Cumberland Breach of Trust

In 1910 James Snodgrass purchased 1300 shares of stock in the Chronicle Publishing Co. from Charles E. Keyes, for a total of $1300, $400 paid at the time of suit. Fannie, Charles' wife signed the contract as security. The contract was ified, Snodgrass returning his stock, but Keyes never returned notes or payment. The suit sought to end the contract & resolve the situation simply & legally.

Glass was owner of city lot in Chattanooga and conveyed it to S.A. Key as trustee to secure a debt of $372 to T.K. Warnacut. If debt was not paid in 8 months, trustee could sell land. Glass charged that said deed was security for debt due Warnacut and nothing more-that he has the right to redeem said lot. Though Glass offered Ragadale $675 but she refused. Glass suing Ragsdale to redeem his property.

View Entry 1872 Jacob & William H. Giesler v. John B. McLin, Trustee, etc. Sullivan Deed of Trust

William Barnett had executed a deed of trust to W.W. Mullindore as trustee to secure certain debts. Gieslers charge that Barnett gave sufficient claims to pay off entire debt, including a tract of land, a carding machine, and livestock-including 3 horses 2 of the 3 horses were then in the hands of Giesler who did not know of the deed of trust. McLin had brought suit for replevin. Gieslers charge the deed is fraudulent-that trustees knew Barnett was selling property and did not dissent.

Divine filed an attachment and injunction suit against Bard and Goodwin from transferring or disposing of any more printing machinery and to have said property attached as payment of Bard's debt. Bard made a deed of trust to Goodwin of 3 printing presses and other machinery relating to printing used in the office of the newspaper formerly known as The Daily Times. Deed was made to secure $2000 from Bard due to Divine by notes.

Esther F. Given, dec. intestate in August 1877. Given owned 3 acres of land boarding defendant land in said county in which she sold her land to defendant in January 1866 for $390 by note. Deed of trust was executed for land in February 1877, making E. H McCroskey, trustee, with powers to sell land if debt was not paid within the time specified. Remaining balance was $95.04. Handwriting faded.

Investment properties fizzled, so family sued. Reconstruction Finance Corporation had a role, so case could be helpful in researching Depression & banking. M. H. Other defendants: George W. Lincoln, Levi Dreyfus, Mary Schoonover, estate of Joseph Schoonover, dec.. Smith, whose full name is C. Canning Smith, is a resident of Davidson County. Plaintiff says Love made a contract with her husband to hold in trust a parcel of land belong to her, and that she should receive all profits earned from that land.
