The plaintiff was a slave owned by the defendant (dec.), who treated him more like a child than a slave. The defendant allegedly told the plaintiff that upon his death, the plaintiff should be freed from slavery, which was put in the will. The administ rators of his will later neglected to fulfill the written and willed desires of the deceased for the plaintiff. |

Allen Deberry made his will on July 12, 1846. He made Absolom Deberry his executor and charged him with freeing Donaldson his body servant, later Donaldson Deberry. Allen died in 1847. Absolom died in 1853 leaving Robert B Hurt as his executor. Donaldson Deberry died in 1859 leaving no will. Caroline Deberry was his widow. She as the administrator of his estate charged that Absolom and by extension Robert Hurt failed to pay the legacy of $500 to Donaldson as stipulate by Allen's will. |
