Pltfs. claimed dfnt. had cut holes in the dividing fence to allow his livestock onto their property, and has excavated two large trees from their property as well. Pltfs. sued for confirmation of their ownership and injunction against dfnt.'s use of land.

Plaintiff was self-described "old woman" who owned County land within few miles of towns of Martin & Sharon, where Def. operated a gin. Through her agent, J.W. Thompson, Somers rented her land to Jesse Burrs, who cultivated cotton on the land. Burrs sub rented the land to the Thedfords, who sold cotton from the land to Def. Burrs didn't pay his rent, so Somers sued Def. because Def. held the cotton derived from the land.

Plaintiff is sued the defendant contestesting the will of her deceased sister, Mary E. Alexander. Plaintiff avers that for months prior to her death she was sick with consumption and Brights Disease, as well as being deaf. Plaintiff was the only one who cared for her during that period and agreed to do so under the understanding that she would be paid when the time came. Plaintiff asks for $3000.
