Plaintiff purchased a tract of land for $600, but the land was levied and the terms of the purchase state the bill was to be made on the last installment of the purchase. Plaintiff paid off the land owner, Baker, not knowing the defendant had already taken over the deed to the land and tried to sell the land again to plaintiff for an inflated price.

2 briefs only. Other plaintiffs: Bunavista McClellan (wife of Thomas); Samuel Swafford, Jr. Other Defendants: W. A. Brown. McClellan also spelled McClellen in documents. Bunavista's parents, Jonathan & Matilda Clark, divorced. Matilda was awarded land in the settlement. Northrup was Matilda's lawyer & obtained decree to sell land to settle $500 promissory note. McClellans were unaware of court proceedings or decree & sold land to Swafford. Plaintiffs want the decree declared fraudulent.

A tract of land laying and being in the 9th Dist., Bledsoe containing 132 acres. Reiley had previously served as county surveyor of Bledsoe. Land previously owned by Mrs. Francis A. Johnson, widow of Baxter Johnson, dec. Failure to surrender deed and settle transaction of land sale.
