In 1884 the deft. filed a bill in the Scott Co. Chancery Ct. for the sale of 2010 acres in that county to satisfy a judgment in its favor & against A. J. C. Robbins. Plntff. paid $2,250 for what he believed was the entire tract, but learned 500 acres had had been excepted out of the decree without his knowledge. This 500 acres was heavily timbered & had induced the plntff. to buy the tract in the first place. He alleged the deft. had defrauded him by exempting this land. |

Kilter was looking to to pay off the balance for the land and was also seeking the court to state that Mary Cowan could not in the future seek money for the homestead or claim ownership. |

Haynes, whose property adjoins said lot, got permission from Samuel to build fence (which he did) but, as it turns out, fence cuts off about 1,000 feet of lot. Emily sued Haynes for forcible entry & detainer & won, but Haynes says suit should've been in name of estate. |

Plaintiffs then paid Hutchins to have her attorney investigate the title. The attorney stated that the title was good. When the plaintiffs attempted to sell a part of said property, a second title search found that Goddard did not have full title to the property. In 1859, the plaintiff was appointed the legal guardian of the defendants, who are the minor children of William Farwater, Jr. (dec.). The defendants became owners of an interest in a tract of land, seized by W. Farwater, Sr. (dec.). Plaintiff believes the defendants would make a higher profit from selling the land to pay off debts and interest on it and is acting in their best interest and asks a guardian ad litem be appointed for the duration of the suit. |
