Angeline & husband Alonzo (dad of the 5 minor children) sued for court's permission to sell remaining 30 acres of the tract (40 acres previously sold to TVA who condemned it to build Chickamauga Dam).

Left personal effects to Templeton Home in Dayton, other individuals. Trustees sued to get permission to help church w/finances due to effects of Depression.

Ziegler executed a warranty deed to W. M. Holder, father of plaintiff and certain defendants. After W. M. Holder's death, Elridge tried to claim sole ownership of the land and subsequent mortgage from the bank. Plaintiff avers that the number of interests in the property makes it impractical for it to be partitioned by a will.
