Birdwell was the owner of 2 tracts of land when defendants took possession of a part of said lands. Defendants disregarded Birdwell's notice to stop trespassing on his land and stop constructing a fence. Plaintiff sued for title to land and recovery for cut timber. Henry Edward Miller died possessed with a tract of land bounded by the American Association on all sides. Plaintiff and other defendant were his children and heirs. Petitioner has asked that the defendant to furnish this land for school purposes but defendants have refused.
