This case revolves around a tract of land, purchased by plaintiffs son Sidney with her money. Sidney married and had one daughter, Mary. Upon his death, defendant was named quardian. Defendant charged with comandeering this property in his wards name. This was accomplished by forcing the deed to be signed over to Mary. Plaintiff further seeking injunction against a writ of possession threatened by defendant, which would put her out of the home she had shared with Sidney. Court ruled for plaintiff. |

3 folders. Original case filed in 1874 for a dispute over land formerly owned by J. Draper, which Cox alleged Fink had fraudulently taken by a land deed from the sheriff. Montgomery was the executor of J. Draper (dec.) and filed a bill against Cox as a creditor to the estate. Later, Fink filed a bill against Cox to prevent him from cutting timber from the said land on the ground that Fink was the rightful owner. The cases were consolidated to render a final decree on the land owner. |

The original bill states that Pla. Fowler and Annie R. Comer claimed to be the heirs of land in Jackson County that was once owned by Lucinda M. Fowler and V. M. Fowler via the will of James G. Cunningham. Despite the land being sold by their father when they were minors, they claimed they are entitled and sued the current owners of the land--the defendants. In 1811, William Moore executed two notes to James Cook for $570. Cook in return sold Moore a plot of land in Carthage. Later Moore discovered that this lot was not legally registered for taxation with the city. Cook then died intestate. The suit was filed to satisfy the terms of the original agreement. |
