Seborn Jewel died intestate, owning 221 acres of land in Districts 12 & 13; also house & lots in Greeneville on Irish Street (2-1/2 acres). Property was situated so as not to be advantageously partitioned. Pla. asked court to sell land, divide proceeds. Pla. are Seborn's heirs: Rachel (m. John R. Moore), Elizabeth (m. Elbert Biggs), Isabella (m. James A. Galbreath), Mary F., David R. (minor). Suit begun as ex parte proceeding but when Elizabeth died, question whether Elbert or Elizabeth's siblings took |

Add def: W. C. Gibbons, Caroline McGaughey, G. B. McGaughey, W. G. McGaughey, A. J. Frazier. Woodruff and Gibbons were partners. Caroline was admr. of S. McGaughey of S. McGaughey Sons & Co. Frazier was the sheriff. In 1877, plaintiff was indebted to Woodruff & Co. and McGaughey Sons & Co. They brought suit and obtained judgement against him and tried to sell his house for debt. McInturff here filed an enjoinment against Frazier from selling the property. |

Plaintiff was the owner of a tract of land, which was levied upon by executions from Justices of the Peace in favor of his creditors in some eleven cases and returned to the court. Plaintiff sold the land and equity of redemption to the defendant and conveyed it by deed and defendant was to pay $1,200 for it. However the sale of the land, part to creditors and part to the plaintiff. |
