In his capacity as constable, Def Charles B. Baker executed judgment that John Baker recovered against pla. Smith by levying against 200 bushels of corn & a rifle belonging to Smith. Believing the levy to be wrongful, Smith sued Baker claiming $250 dmgs. Smith rented land on John Baker's plantation & cultivated crops on said land. John Baker sued Smith for not cultivating said crops in accordance with a contract between them & obtained a judgment, which resulted in the levy at issue in this case. |

Dispute re piano forte belonging to Mulholland, purchased from his brother Michael in 1854 in Virginia. One year after buying the piano, Peter loaned it to Michael's wife Teresa for her to use in teaching piano. Def. then levied on the piano to satisfy Michael's debt, which led to this suit wherein pla. claimed such levy was wrongful. |

Suit for damages for wrongfully & maliciously sued out ancillary attachment. Arnold bought goods, including whiskey, from S.W. Cooley, who falsely represented to Arnold the cost of the whiskey, thereby procuring note from Arnold to pay same. Cooley obtained judgment against Arnold & sued out ancillary attachment to enforce it, levying same on Arnold's property, causing Arnold $5,000 for damage to his business & reputation. W.R. Cooley & Harris were securities for S.W. Cooley. |
