Owen admr. for & father of Clopton Owen who, on 29 Sept. 1908, was struck and killed by a streetcar owned & operated by the defendant as he was walking home from school. Owen sued for $25,000 in damages. Owen charges negligence in that the motorman gave no warning of his approach & the street car was not equipped with a fender which, had it been present, could have prevented the injuries that took his son's life. Defendant accused of operating a rail car that "was propelled upon and against said John T. Baker with great violence, causing his death, and that said death was caused by the negligence and carelessness" of the railway company. The complainant charged operators' incompetence, high speed, improper equipment, and failure to use effective warning for an oncoming car. |

Company stated that he had signed a contract relieving railroad of any responsibility for injury or death. Vesta McBride wanted compensation for her son's death.
