Case file incomplete; brief only. In May, 1883 Acuff contracted with Cox to sell him a tract of land in Raccoon Valley containing about 130 acres. Price for the land was $800.00. Cox paid about $450.00. and executed a note for the remainder. At the time See ET Box 1871 as well - no deed or title was drawn as some surveying needed to be done. Cox became very ill and Acuff was advised to draw up a deed but kept the deed in his possession. Cox recovered and refused to acknowledge deed as was written. |

Moyers charges Sharp & Houston for cheating and defrauding her of a valuable tract of 100 acres. Houston pressured Moyer to sign deed in which Houston promised to pay $25 a year for 5 years for lands he claimed was worth little. Houston gave note for $125 (for land Moyers found out was worth $800-900), which he never paid. Houston then fraudulently conveyed land to Sharp to avoid vendors lien in scheme to not pay for land. Moyers asks their deeds be made void and land given back. |

Elizabeth accusing her husband James of adultery, citing a recent occurrence of James going to a brothel where he stayed until 4 am with the widow Jane Snodgrass. Elizabeth not sued for a full divorce but divorce from bed and board, alimony, and custody of their two youngest children. She wanted an injunction restraining James from disposing of any of his property. Court ruled in her favor for 12 months divorce, $50 alimony, and visitation rights to her children. |

Hubbs owned land on Flat Creek but went into debt and was forced to sell it in court to Howard Howell in 1872. Hubbs went to his neighbor Kelley and entered into an oral contract, wherein Kelley would put up the purchase money and Hubbs could reclaim the land. This motion was brought to enforce Kelley’s payment so that Hubbs may claim his redemptive right to the land. 228 pages in ET1959 |

James Hubbs was ordered to pay approx. $80 on a note due to Elijah Atkins and Williams Skaggs Caloway Kelley was indebted to Atkins for $80 who gave a note with Hubbs as his security. Caloway and Roland Mettabarger (security for stay of execution) have passed away. Hubbs charges that their estates should pay for debts, not him. |

On 4 April 1859 complainants executed a $676 note to the Circuit Court Clerk for a slave sold under a decree of that court. On 2 Oct. 1860 the clerk's successor reported that the note was unpaid & rendered a judgment for $736, the entire amount plus interest, without notifying complainants. Complainants seek to enjoin an execution from the Court, also state that they did make payments on the note that were not properly recorded. |

Defendants: C. H. Rogers, I. G. Leabow, J. K. Love, and Alex A. Arthur. Plaintiff hired Rogers, Leabow, and Love to sell a large tract of land for him. They convinced him to sell it for $10 per acre despite his belief it was worth more. Arthur acted as the trustee. Bowman alleged that the defendants then sold the land for $15 per acre, committing fraud. He sought payment of full sale price. Includes reported case book. Exhibits are checks relevant to case. |

Warwick was a cattle dealer who had a checking account with the Maynardville State Bank. He took checks from various people and deposited them in bank. One day, he gave a check to Archer for $456 in a Graves & Seymour Grocery Co. to take to the bank. When Warwick balanced his account, he was not credited with the amount either due to bank's oversight or Archer's withholding said deposit. Exhibits include 2 check books and 1 receipt book. 2 folders. |

In 1851 James Norton deeded a tract to his son Amos Norton. Amos was at the time was "an idiot, is now an idiot, and he has been his entire life." He should have a trustee. In 1854 James sold the land to John Allred and Jesse Carroll. In 1860 Carroll sold his portion to Lewis Loy. Then Amos's stepmother installed Amos in Carroll's vacated house so that Loy couldn't take possession. Amos's only property was "an old quilt which is placed upon a pile of straw on the floor…." Complications developed. |

Concerns land deeded by plaintiff to defendant 9 Dec. 1865. The case materials relate that Haynes Sr. was indicted for treason at the end of the Civil War. Knowing that most individuals indicted for treason at that time were stripped of their property, his son talked him into deeding his land to him to hold until such time as everything could be settled. 24-5 years before, William Harbison had bargained and sold or contracted to sell a tract of land to the defendant. Harbison sued Cassaday [alt. spelled Cassady and Cassidy] for unpaid promissory note for the purchase money. Harbison wanted to enforce the lien, sell the land, and its proceeds used to pay the note. |

Turner - as the firm of Warwick, Turner and Son on a note for $961.10 payable to R. B. Bishop. To ensure Huddleston's participation, Turner promised a deed of trust on his property. Turner defaulted, Huddleston was in danger of losing his property as surety, and sued to prevent that from happening. |
