Russell was appointed guardian of Andrew & his sister Porthenia Green, both then minors, w/Forrest & Curtis as Russell's securities. Before Russell, John W. Hoyt (now dec) was guardian for Andrew & others, all minor heirs of James S. Green, dec. Andrew filed this bill to get final settlement of said guardianship from Russell. During the guardianship, Andrew says he lived with Russell (from age 8 to age 17) & worked for Russell during crop season & other times. |

Jane C. Brackett divorced Adkins Brackett and was awarded one-half of his assets. Additionally he was made responsible for court costs. When he couldn't afford it, the sheriff levied the costs upon his land. Brackett argued that would make him destitute, therefore unable to pay alimony. When the sheriff auctioned the land at a courthouse sale, the high bidders were Owens, J. M. Clementson, W. L. Lane, W. S. Jaston, and E. L. Miller. Brackett (who later married Eliza Haney) asked the court to void sale. |

Similarly to their case with Borches & Co., J. L. Brooks made a chattel mortgage through Arnold, Henegar, and Doyle, a shoe and boot company, using farming implements as collateral. No information stating the purpose of borrowing this money. It would appear that the Brooke's were attempting to set up some sort of mercantile and levied their personal belongings to stock the store. See other debt case for J. L. Brooks in ET1 also. |

John Scarbrough died intestate in September 1872, leaving a widow, Catherine, who died not too long afterwards. Upon her death, their children became heirs: Elizabeth, Minerva, Mary, William, John, Ellen and Lexie. J. B. Reed became administrator, but he found estate hopelessly insolvent. Complainants found no evidence that he ever made a schedule of assets. Old Scarbrough mortgaged his property to J. H. Scarbrough, but left much debt at his death. Inventory of purchases highlights material culture. |

Spencer Beavers (dec), as county sheriff & collector, sold 93 acres owned by Isaac Fyffe heirs that adjoined Walker Reservation, which land went through several conveyances ending with purchase by Brock, but each deed had same clerical error in the description. Brock says heirs (Def.. Mees & Fyffes) knew of sale yet have tried to claim land due to this error. |

The defendant secured a promissory note to the Bank of Tennessee with a deed of trust for several slaves. The debt became due and the plaintiff is seeking transfer of ownership of the slaves. Plaintiff is also seeking an injunction prohibiting the relocation of the slaves to Knoxville, arguing that slaves will become sick due to epidemic. The slaves are Katy 43, Jordan 18, Henry 16, Julia 23 and her daughter Clarissa 9. |

Pickens wants injunction against Ballow to keep him from prosecuting his action of ejectment. Plaintiffs charge that Ballow is entitled to only part of the land. |

Tucker died intestate in July 1880, seized and possessed of a parcel of land containing about 480 acres lying in McMinn County. C.L. Tucker conveyed his interest in the land to Mont. Reynolds and asks the court to sell the land for partition and the funds deriving from the sale be divided among the entitled parties. See also ET box 1910. |

Plaintiff was later sued for said note by Rice in the absence of Gibson. Plaintiff then issued a note to Rice and in return Rice signed over his note against Gibson. Plaintiff claims Gibson has since failed to pay. |

Cleage recovered a jdgement against Matlock for $3014.64 in the circuit court in 1880. The sheriff returned the execution "a bona" and the judgement remained unsatisfied. Matlock had no property except land he claimed was hoemstead. Cleage asserted that the land was subject to sale for repayment because the debt was accrued in 1860, prior to the passage of the homestead law. |

Plaintiff Haskins sued the defendant as his security for a $800 note executed to Joseph McCulley for money loaned to Hammond. Haskins and Varnell charged that Hammond, after accumulating many liabilities and creditors, conveyed his lands to his wife Mary to avoid his real estate being subject to liability for his debt. Plaintiff requested the court declare the conveyance fraudulent and subject the defendants property to sale for repayment of debts. |

Again day was set & marriage license procured, but on set day, Moore failed to show & Eaton hasn't seen him since. She filed suits against him in Circuit (debt suit on $1250 marriage license bond & breach of promise suit); filed this suit to keep him from disposing of property: negro women Rose & Caty & negro men Jack & Daniel, 341 acres Hiwassee District land. |

Elizabeth McClemon gave six or seven thousand dollars to her brother in law, Francis Pettit to purchase land in McMinn County. He purchased the land in his name only and allowed her to live and farm on part of it. Pettit died without a will and now Elizabeth is in a dispute with his heirs over her right to part of the land. |

Cate demands balance due him. |
