Complainant filed this bill to foreclose a mortgage on a deed in trust. Brief Only. See related suit brought by his son David McRoberts v. J. M. Copeland et ux. for repayment on the same mortgage, box ET 1863.

Russell was appointed guardian of Andrew & his sister Porthenia Green, both then minors, w/Forrest & Curtis as Russell's securities. Before Russell, John W. Hoyt (now dec) was guardian for Andrew & others, all minor heirs of James S. Green, dec. Andrew filed this bill to get final settlement of said guardianship from Russell. During the guardianship, Andrew says he lived with Russell (from age 8 to age 17) & worked for Russell during crop season & other times.

Similarly to their case with Borches & Co., J. L. Brooks made a chattel mortgage through Arnold, Henegar, and Doyle, a shoe and boot company, using farming implements as collateral. No information stating the purpose of borrowing this money. It would appear that the Brooke's were attempting to set up some sort of mercantile and levied their personal belongings to stock the store. See other debt case for J. L. Brooks in ET1 also.

John Scarbrough died intestate in September 1872, leaving a widow, Catherine, who died not too long afterwards. Upon her death, their children became heirs: Elizabeth, Minerva, Mary, William, John, Ellen and Lexie. J. B. Reed became administrator, but he found estate hopelessly insolvent. Complainants found no evidence that he ever made a schedule of assets. Old Scarbrough mortgaged his property to J. H. Scarbrough, but left much debt at his death. Inventory of purchases highlights material culture.

The defendant secured a promissory note to the Bank of Tennessee with a deed of trust for several slaves. The debt became due and the plaintiff is seeking transfer of ownership of the slaves. Plaintiff is also seeking an injunction prohibiting the relocation of the slaves to Knoxville, arguing that slaves will become sick due to epidemic. The slaves are Katy 43, Jordan 18, Henry 16, Julia 23 and her daughter Clarissa 9.

The plaintiff claimed that he entered into a land contract with the defendant who represented himself to be the executor of the last will and testament of Abijah Bogges deceased. The defendant and plaintiff disagreed on the interpretation of the contract and the plaintiff asked for an injunction all suits by the defendant demanding payment.

Additional plaintiff: Margaret Peters, formerly Smith, widow of Joseph Smith, dec. Additional defendants: Isaiah Smith and Calloway Smith. Joseph Smith possessed an estate worth $745 after payment of debts. Margaret Peters suing for possession of land due her as widow. Pickens wants injunction against Ballow to keep him from prosecuting his action of ejectment. Plaintiffs charge that Ballow is entitled to only part of the land.

M., Wilbur & John Grant who did business under name of J. M. Grant & Sons. Plntff believed defts. fraudulently disposed of their property to avoid their debts & ask Court to attach parcel of land Charles & wife conveyed to Nancy Grant. Chalfant, Cox & Co. based in Philadelphia. (Isaac P. Chalfant & Lewis S. Cox). See also ET 1878.

Cleage recovered a jdgement against Matlock for $3014.64 in the circuit court in 1880. The sheriff returned the execution "a bona" and the judgement remained unsatisfied. Matlock had no property except land he claimed was hoemstead. Cleage asserted that the land was subject to sale for repayment because the debt was accrued in 1860, prior to the passage of the homestead law.

Jacob Fisher became indebted to Samuel Cleage, Alexander Cleage, E. Birdseye [Birdseys?], and to Cleage & Crutchfield, merchants. Others involved: William Matthews, Andrew Hutsell, William T. Fisher, John A. S. Fisher, Henry H. Rider, Jacob Haller, Absalom Fisher, Hiram Tartar, James McDaniel, R. T. Engledow, James B. Taylor, Hilton Humphreys, Andrew McKeldin, William Burns, G. W. Mayo.

Plaintiff Haskins sued the defendant as his security for a $800 note executed to Joseph McCulley for money loaned to Hammond. Haskins and Varnell charged that Hammond, after accumulating many liabilities and creditors, conveyed his lands to his wife Mary to avoid his real estate being subject to liability for his debt. Plaintiff requested the court declare the conveyance fraudulent and subject the defendants property to sale for repayment of debts.

Dispute over $10,000 life insurance policy on Lillian Hutsell (beneficiary: dad Ernest Oland Hutsell). Lillian was bookkeeper at Bank accused of embezzlement. After she was discovered she committed suicide. Exhibits include suicide note, receipts, accounts, etc. There are 9 folders, 7 of which make up the entirety of ET 1341 and 2 are in ET 1340. Defendant was trustee over land & property left to plaintiff in estate of her father, Jackson Smith. Plaintiff was sued to gain control over land & property herself. Property included a slave, Sam. No additional defendants specifically named. Her brother , Nathaniel D. Smith, had been ex. of father's estate.

Additional plaintiffs and defendants listed in file. The plaintiffs all have direct and personal interest in the indebtedness incurred by the Town of Etowah, listed as a defendant, which will cause the plaintiffs to unjustly lose legally owned land. The plaintiffs are seeking an injunction to keep the defendants from illegal expenditures that would result in extreme burdens and financial loss on the plaintiffs. The defendants want to build a municipally owned electric and light plant for the town.

Incomplete file; opinion only. States that the amount due Erickson and Baxter should be reduced from $598.85 to $527.99.

Eaton & Moore entered into marriage contract & set a date but, before that day, Moore asked to postpone because his son was sick. Again day was set & marriage license procured, but on set day, Moore failed to show & Eaton hasn't seen him since. She filed suits against him in Circuit (debt suit on $1250 marriage license bond & breach of promise suit); filed this suit to keep him from disposing of property: negro women Rose & Caty & negro men Jack & Daniel, 341 acres Hiwassee District land.

Additional defendants: J.M. Johnson and W.P. Arme[?]. Cate sued defendants for $2,283.70 for debt. Cate showed that defendants collected produce for Confederate armies and forcibly took 397 sacks of flour and 2,003 pounds of bacon worth $4,570 and compelled Cate to accept Confederate scrip against his will. Cate demands balance due him.

Other defendants: R. Buchanan, W. R. Carver. On March 4, 1884 the bank loaned $85.00 upon a joint and several note signed by R. Buchanan, W.R. Carver and J. G. Hale. The loan was made based upon the good financial standing of Carver and Hale.
