J. F. Biffle, Buchanon, and Edwards executed a note to the defendant bank in 1893. Biffle was the principal and the plaintiffs were the sureties. When Biffle defaulted on the note, a judgement was rendered for the bank and the plaintiff surities paid the note. However, the refused to pay the attorney fees of the bank, claiming they were unreasonable and that a judgment was reached quickly. |

Bailey (dec. husband of Maria L.) transferred to Enoch Brown, which they claimed was misappropriated and against the trust deed of the estate. Plaintiffs requested the return of land conveyed by the note and debt on note. |

In 1889, J. P. Williams, A. M. Shook, Nat Baxter Jr., and G. M. Fogg (partners) purchased an iron furnace from the Warner's and Mrs. Goodrich, executing four notes signed by each of the partners. When the sellers demanded payment of the note, the defendants borrowed $9,296 from the plaintiff bank. Williams was also vice-president of the bank at the time and illegally instructed a cashier to remove the name of Shook from the note. Exhibit is note issued by parties. |
