Both Sherry and his co-defendant, Dennis Saxton, were from Shelby County. John McKinley died leaving two lots of land in Memphis. The plaintiffs include Andrew McKinley of New York, Luther T. Thurston of Kentucky, Mary Churchill of Louisville and her daughter Mary Moss Churchill, Julia January and her husband Derick A. January of St. Louis, and Robert M. Patton of Alabama. Plaintiffs allege that the lots were never sold to the defendants and that they obtained possession of them illegally.

Additional Defendants: Ivory Hamby, Thomas Carter, S. W. Ely, Joseph Sagebeer, and Edmund Baxter. Anna and her husband Henry B. Richards of Newark, New Jersey, sued the defendants to claim title and regain possession of a tract of land in Morgan County. The Richards claimed the defendants wrongfully claimed ownership and proceeded to take timber and otherwise disturb the tract for their own gain. Exhibit is an oversized map of land tracts in question.

Other defendants: G. W. Kite & wife. Lipford sold tract of land to Kite. Dispute over mineral rights concerned Kite's sale of land to the state which intended to use the limestone rock for building highways. Kite felt wronged by the sale & filed an injunction hoping to stop further removal of rock. Lime was commonly used for agricultural purposes. Also mentioned: D. E. Slemp, Godfrey Stout, W. H. Add def: Next friend T. C. Dillon, Jack Greece, Margaret Greece, Bessell May Marshall. The land originally belonged to Henry Marshall, dec. 1892 intestate. His son Tom Marshall, was married to Augusta, Bessell was his child. Henry was indebted to J. D. Knies, who foreclosed on the land sold it to Milton. The plaintiffs, ancestors of Henry, here disputed the sale.

View Entry 1885 Alva Breece v. J. M. Bond & H. C. Hunter Hickman Land and Title Dispute

Breece bought 2 pieces of Hickman County land from T.S. Easley & his wife L.J. Easley, after which Def. Bond became security for a debt T.S. owed & ultimately got a judgment against T.S. for that debt & tried to execute that judgment against this land. Hunter was the sheriff charged with levying against land to satisfy judgments. Breece asked court for injunction to keep Def.. from selling the land. Main issue was whether Breece's deed properly registered. Witnesses: Walker, Thomas, Bates.

View Entry 1844 Anderson Skillern, et al. v. Joseph G. Smith, et al. Bledsoe Land and Title Dispute

Add. Plaintiffs: John Skillern, Henry Miller. Add. Def: James A. Whitesides (later dropped from case). The 2 Skillerns, Miller & Smith formed partnership to speculate in mountain lands, including 10,000 acres in Hamilton County. Per consent of partners, Smith went north to try to sell land & did sell land to Dr. Joseph Evans of New York, in exchange for land in Village of Jamaica, Long Island, NY. Plaintiffs sued Smith to account for proceeds of sale.

Add. defs: John G. Brazelton, Robert Cox, Edward Herndon. Parmley's land sold at execution sale to Brazelton, who sold to Hale, but description in sheriff's deed was defective, such that title was not conveyed. Defs. successfully sued to reform deed & have title divested out of Parmley, who tried to appeal, but confusion over bond on appeal led to disallowance of appeal, leading Parmley to file this Bill of Review.

Additional def.s.: Thomas C. Johnson & wife, Nancy J.; Robert Love; Isaac P. & James P. Tipton. Thomas C. Johnson son-in-law of plaintiff. Plaintiff left 180 acres by his father Samuel Tipton which he deeded to Johnson. Chancery Court decree has since divested Johnson of his title to the land, but plaintiff believes that he has sold it to Powell to pay his debts despite having no legal right to do so.

Other defendants: George Farler [?], Sarah Jane Anderson, and Gabriel M. McCraw. Vandeventer claims that John Edwards never paid for the land.

Plaintiff stated that they held the title to a tract of land. Plaintiff also stated to the court that the defendants were creating false titles to the land. Plaintiff seeking full rights to the land. Additional defendants: William W. Rockhold and Warrington C. Hunt. Hart had bought a house and lot and all stock of the firm Darault & Brown. Hart sued for title to property and wanted an injunction against defendants from selling, transferring, or otherwise disposing of said title to property. Hart also suing for: $1300 Darault was to have paid Isaac H. Brown and $1000-the deficit of the partnership books.

View Entry 1932 Alice Chadwell et al. v. Ross Chadwell et al. Claiborne Land and Title Dispute

Additional Plaintiff: Porter Chadwell. Additional Defendant: Viola Chadwell, wife of Ross Chadwell. Plaintiffs and defendants are the heirs of George Chadwell and share in the lands he left to his family after his death. Plaintiffs complain that Def. Ross sold his interest in said property to them. However the Defendants are now divorcing and Def. Viola is claiming an interest in said land. The land in question lies in the 5th Civil District of Claiborne County, Tennessee.

Add Pla: William A. Nance and Susan Nance Hamilton, wife of A.J. Hamilton. Add def: Martha J. Nance, John Y. Cooper and wife Margaret J. Cooper. In 1866 land belonging to Andrew Castleman located in the 11 Civil District of Davidson County was equally divided amongst his twelve heirs. In 1893 pla. brought suit complaining that W. L. Nance was falsely claiming ownership of said land. Casefile notes William A. Nance was confined to the State Insane Asylum in Nashville for 16 years prior to the trial.

View Entry 1878 Adkins Brackett v. P. P. Owens, et al. McMinn Land and Title Dispute

Jane C. Brackett divorced Adkins Brackett and was awarded one-half of his assets. Additionally he was made responsible for court costs. When he couldn't afford it, the sheriff levied the costs upon his land. Brackett argued that would make him destitute, therefore unable to pay alimony. When the sheriff auctioned the land at a courthouse sale, the high bidders were Owens, J. M. Clementson, W. L. Lane, W. S. Jaston, and E. L. Miller. Brackett (who later married Eliza Haney) asked the court to void sale.

Branscom was variously written as Branscomb. Addtl defs: Geo. F. Squibb, M. F. Geralds, M. S. Mahoney, W. C. Hale, Martin Hodges, Wm. C. Hale, Peter Bashor, Geo. McPherson, and Nathan Shipley. Mary was formerly married to J. A. Branscomb, before his elect ion as Revenue Collector for Wash. County, the other defs are sureties on his official bond of 1869. Branscomb is attempting to execute a deed to the tract of land on which she and their kids are living.

View Entry 1892 Andrew Cole, c. v. Levi Cole, c. Davidson Land and Title Dispute

The interior of the file noted both men were colored. Complaintant was the son of the defendant, both men went in to purchase a plot of land in "Haslams Plan" on Warren St. Defendant asserted he only wanted the right to quarry for rock on the plot, and afterward would give his share to plaintiff. Plaintiff had recently found his father did not put the deed in both of their names nor signed the land over after quarrying was complete. Complaintant has lived in a house on the plot for 6 years.

Case deals with dispute between the two parties over purchase and rightful ownership of a tract of land in Greene County. Alexander Hicks purchased the property from Thomas Brandon and E.W. Headrick. He paid part in cash and executed notes for remainder.
