Add. plaintiffs: H. B. Bancroft, Wetherill See, Thomas S. Footer, & John W. Bray, all surviving members of Bancroft & Company. Add. defendant: A. T. Wester. Boyd and Wester were partners doing business under the firm name of Boyd & Wester and are justly indebted to the plaintiffs. In 1866, the plaintiffs obtained a judgment against the defendants for $3,138.57 and defendants levied 560 acres against the debt, conveyed by G. Delozier to Boyd in 1853, but there was an issue of the rightful title holder.

Eli died leaving wife Nancy G. & children Henry W. (age 32), Sonisa (22), & John A. (minor, 19), as well as son Madison (who if living would've been 25) who left state & went to parts unknown & thought to be dead, all of which heirs are additional defs. Before he died, Eli agreed to buy from George Gallagher land on Grassy Creek as home for his family & procured Ellis to help him do that. Before time for payment elapsed, Eli died, at which time he was in possession of the land. Dispute over title ensued.

When O'Conner died 10 Oct. 1882 Fletchers purchased his interest in company & land from his widow. Plntff. maintains that legal title to the land should be vested in him.

The plaintiff alleges that two of the additional defendants, Thomas B. Morrison and M. L. Morrison, purchased the right to mine iron ore on the land belonging at the time to their father, Allen D. Morrison. The plaintiff further alleged that the sons did not pay and somehow he took over the mining operation. The plaintiff claimed some or all of the land was conveyed to him by Allen D. Morrison before his death. See ET 1856.

Add. defendant: John Bailey. John Eblen (dec.) was the father of K. Johnston and left a will to divide his remaining estate. He left a tract of land to his heirs, the plaintiff, but a trustee has not been named for the land. The plaintiffs are described as old and feeble and could not obtain a deed of trust. The defendants took over possession of the property unlawfully without giving any rent and now refuse to vacate the land.

Additional Defts.: William Lockwood & C. W. Stewart. Plntff. had laid out the villages of Old Rockwood & New Rockwood, & had appointed Wilder its agent, authorized to sell lots only in New Rockwood. Plntff. alleged that Wilder made an unauthorized sale of Lot 2 in Old Rockwood to defts. Lockwood & Stewart who claimed full title to the lot, but made no effort to pay for or rent the property. Plntff. asked court to force defts. to surrender whatever title they might hold & return possession of lot to it.

Sparks, Clerk & Master of the Chancery Court of Roane Co., certified that the map was a "full, true and correct copy" of the map that was an exhibit in the case. See: ET, Box 704.

Defendants owned a tract adjoining plaintiff's land that was willed to their father, W.M. Martin, also by Elisha Martin. Dispute over boundary of two properties, which had been sued in court before. Add. defendants: George L. Gillerpin & Harry L. Weleker. Plaintiff entered into a contract with a Walter King for a tract of land but an actual deed may or may not have been created. After his death, Walter King's heirs and put up to public sale without much attention paid to boundaries. John S. King purchased the tract of land on which Martin lived and bought and King attempted to take an action of ejectment against him.

Littleton Jr. Thos. executed deed to Samuel Eskridge (dec) to secure payment for debt he owed Eskridge, but deed intended as mortgage. Once debt paid, Eskridge reconveyed land but, before that happened, Matlock bought adjoining tract from Eskridge, but his deed included more land than intended & included part of land conveyed to Littleton. Matlock sued over dispute in Circuit (ET Box 1102); this suit brought to enjoin said suit

Additional Plaintiffs unknown. This case involves deeds made from James and Jane Ambrose to the children and heirs of Jesse Pressley and Maggie Hood. There appears to be a controversy surrounding the language of said deeds and the intentions of James Ambrose to leave a life estate to his wife Jane.

Staples purchased two lots of land from Roberts in 1857, executing a note to Roberts for $927. Because the land really belonged to Sarah Roberts, the deed issued for the sale was imperfect. Case sought to settle title and ownership of land.
