McSween attempted to sell land to Charles Kelly & his heirs on the French Broad River, a piece of land that included a ferry & ferry rights. Kelly had willed the land to his heirs, although the land did not belong to him, but to Mr. Brooks. The suit accused McSween of champerty (illegal agreement in which a person with no previous interest in a lawsuit finances it with a view to sharing the disputed property if the suit succeeds). |
