The impact of the collision hurled the plaintiff over a fence and prostrate, to the ground- rendering him unconscious until the next day. |

He claims there was no one on the back of the train to watch for people or obstacles, and no warning whistle, and that the noise of the passing train blocked the sound of the train on the siding. |

The principal argument for the plaintiff seems to be that that crossing had been used for many years and that the train crew should have looked to see whether anyone was on the track before moving. |

The deceased was riding his horse along a road and saw the defendant coming towards him in his automobile. The deceased went to one half of the road to let the defendant pass, but the defendant remained in the middle of the road, willfully and negligently hitting L. Kelley, making his horse fall on him and causing fatal injuries. |
