Campbell offered to buy out Nunley's interest in the store and asked pltf and Nunley to sign a note to him. Pearson only signed the note if he wouldn't be held as surety for the whole amount, only half, if Nunley did not pay. The Nashville Trust initially sued to recover the debt on the note. |

Plaintiff hired the defendants to haul logs to his saw mill located in "Corn Branch Cove," in Grundy County, Tennessee. As part of their agreement the plaintiff agreed to endorse a note for the defendants to purchase a team of oxen to haul the logs. Defendants broke their contract with the plaintiff and took the purchased oxen to haul logs in another area. Plaintiff was sued on the note and brought this suit to collect the balance owed by the defendants. |
