Plaintiff is the administrator of the estate of Will Johnson (dec'd), who was employed by the defendant to clean and maintain certain train cars. During the course of his regular work, a conductor employed by the defendant carelessly and without warning started moving the engine the deceased was working on without warning, causing certain parts to crush and mangle the deceased about the head, causing fatal injuries. Suing for $15,000 in damages.

Mrs. Parsons widow of W. H. Parsons, Jr., who was killed in FL when the car in which he was riding collided with a car driven by Albert H. Garnier. Garnier was also killed in the accident. American Trust administrator of his estate. Mrs. Parsons suing American Trust for compensatory damages in the wrongful death of her husband. Possible that the Garnier car, which was facing the car in which Parsons was riding, did not dim its lights as required by FL law. See also box 1542

William Hargrave, son of J. A., was untrained in using an emery wheel at the machine shop where he worked. The wheel was faulty & exploded, killing William. J. A. sued to recover damages from the death of his son. The machine shop alleged that they were not responsible for his death. See box 747 for Add'l documentation.

In April 1890, Lee Malcolm was crushed and killed between two passing cars owned by the plaintiff in error at the intersection of 9th and Market Street in Chattanooga. He was an employee of the company but not on duty at the time.

This was a petition for compensation brought by plaintiff, an employee of defendant company, for an injury received while on the job.

Plaintiff is the administrator of the estate of Rufus Teffeteller (dec.). Defendant is the receiver for the Central Georgia Railway Company. Plaintiff is sued for the wrongful killing of the deceased with damages of $10,000. In 1936, the defendant was operating a passenger train at a high and reckless speed, on which the deceased was a passenger.

Morgan petitioning for writs of certiorari, which was dismissed. Court ruled in favor of defendant who is to recover cost of cause from plaintiff. Morgan moves for new trial, is refused, and then tenders his bill of exceptions and appealed. Previous case mentioned between L. Gothard for use of Thatcher v. Morgan and A.A. Pearson for debt in which court ruled in favor of Gothard for $62. Morgan charges that he is not liable for note and could not defend himself in court due to sick child.

Incomplete case. Petition to Rehear only, which states that court heard def.'s expert opinion on the construction of stairs but refused to hear plaintiff's expert opinion (claimed they were not permitted to present testimony to dispute def.'s testimony). Petition to rehear was denied. Original cause of action seemed to be Petition for Certiorari.

Plaintiff was the widow of Henry Estill who was killed by a Pure Ice truck as he walked across Brainerd Road. Estill suffered for a week until he died. Ruth sued on account of Henry's physical pain and mental anguish and to recover large medical bills. Photographic exhibits (f. 4) document the area of the accident. Additional Defendants: Frances, Ralph, Alfred, Dorothy & Robbie Shepard, all minors & children of Jack Shepard. Shepard originally sued Diamond for $25,000 damages in the death of his wife, Rose. She was involved in an accident with Diamond on 6 July 1934 while a passenger in his car. Diamond was driving at excessive speed, lost control & wrecked when he encountered cattle in the road. Rose Shepard died of her injuries 2 days later. Accident took place in GA.
